The legal agreement between you and Forex Broker Checker when you use this Site.
By accessing or using ForexBrokerChecker.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to any part of these Terms, you must stop using the Site immediately. These Terms apply to all visitors, registered users, contributors, and anyone otherwise accessing or using the Site.
1. About this Site
Forex Broker Checker (the "Site") is an independent online research and comparison resource focused on the retail forex and Contract-for-Difference ("CFD") industry. The Site aggregates publicly available regulatory information, industry data, editorial opinions, and user-submitted feedback about brokers operating in the retail forex / CFD market. The Site is not operated by, affiliated with, sponsored by, or endorsed by any of the brokers featured.
2. Editorial opinion, not statement of fact
Unless an entry on the Site explicitly references a verifiable third-party source (such as an official regulator's public register or a published enforcement action), all reviews, ratings, rankings, scoring, commentary, comparisons, and watchlist entries on the Site constitute the editorial opinion of the Site's editors and are not statements of fact. They reflect our subjective assessment based on publicly available information at the time of publication. Different reasonable observers may reach different conclusions on the same evidence.
3. Not financial, investment, legal, or tax advice
Content on the Site — including broker reviews, ratings, comparisons, market data, educational articles, news, ranking positions, scores, the watchlist, and any opinions — is provided for general informational purposes only. Nothing on the Site constitutes financial, investment, legal, accounting, or tax advice, nor a recommendation to buy, sell, or hold any financial product. Forex Broker Checker is not a registered investment adviser, broker, dealer, financial planner, or other regulated financial services provider in any jurisdiction. You should consult a qualified, locally licensed financial adviser before making any financial decision.
4. Risk warning — leveraged products
Trading forex and Contracts for Difference (CFDs) is a leveraged activity that carries a high risk of loss. The leverage available on these products means small market movements can produce disproportionately large losses, including losses that can exceed the funds you have deposited (depending on the broker, jurisdiction, and account type). Regulators in major jurisdictions, including the UK Financial Conduct Authority ("FCA"), the Australian Securities and Investments Commission ("ASIC"), and the European Securities and Markets Authority ("ESMA"), have reported that approximately 70-85% of retail CFD accounts lose money. These products are not suitable for all investors. You should not trade with money you cannot afford to lose. Past performance is not indicative of future results.
5. Not a financial promotion
Nothing on the Site is intended to constitute, and the Site does not provide, a "financial promotion" within the meaning of section 21 of the UK Financial Services and Markets Act 2000, nor an "investment recommendation" within the meaning of the EU Market Abuse Regulation, nor a similar regulated communication under the laws of any other jurisdiction. The Site is an editorial publication: it discusses brokers and products that are publicly known, in the manner of journalism and consumer research. The Site does not arrange, advise on, or solicit transactions in any financial instrument.
6. Affiliate, referral, and commercial disclosure
The Site may participate in affiliate, referral, or partnership arrangements with one or more brokers featured on the Site. Where such an arrangement exists, the Site may receive a one-time or recurring commission, fee, or other consideration when a user clicks an outbound link and subsequently opens an account or executes trades with the linked broker. The presence or absence of an affiliate arrangement does not influence editorial judgment, scoring, or ranking, and brokers cannot pay for higher placement. Where a broker partnership exists, this is disclosed on the relevant broker page or via a general disclosure on the Site.
7. Independence and editorial integrity
The Site operates editorially independently from the brokers it reviews. No broker has reviewed, approved, or has any veto right over published content prior to publication. Brokers are not given preferential treatment in scoring, rankings, or visibility in exchange for commercial relationships. See our Editorial Methodology for detail.
8. No warranty — Site is provided "as is"
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Forex Broker Checker disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, timeliness, uninterrupted availability, error-free operation, freedom from harmful components, or security. We make reasonable efforts to keep broker information current and accurate, but regulatory status, fees, instruments, account terms, and platform features change frequently and we make no representation that any specific item of information is up to date. You must verify all current details directly with the broker and its regulator before opening any account or making any financial decision.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Forex Broker Checker, its operators, owners, employees, contractors, affiliates, contributors, or licensors be liable to you or any third party for any indirect, incidental, consequential, special, exemplary, punitive, or aggravated damages, including without limitation: lost profits, lost revenue, lost trading opportunities, lost data, lost goodwill, business interruption, or any losses arising from or relating to: (a) your use of or inability to use the Site; (b) any decision to open an account, deposit funds with, or trade with any broker; (c) any inaccuracy, error, omission, or delay in the content; (d) any unauthorised access to or alteration of your transmissions or data; (e) the conduct or content of any broker, third party, or other user; or (f) any other matter relating to the Site. The aggregate liability of Forex Broker Checker to you arising from or relating to these Terms or the Site shall not exceed fifty US dollars (USD $50) in any 12-month period. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Forex Broker Checker, its operators, owners, employees, contractors, affiliates, contributors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, expenses (including reasonable legal fees), or debts arising from or related to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) any content you submit to the Site (including reviews); (d) any decision you take based on Site content; or (e) any violation by you of any third-party right, including without limitation any copyright, property, defamation, privacy, or contractual right.
11. User submissions, reviews, and content
If you submit a review, comment, or any other content to the Site (collectively "User Content"), you grant Forex Broker Checker a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully sublicensable and transferable licence to use, reproduce, edit, translate, distribute, publicly display, publicly perform, modify, adapt, and create derivative works of your User Content in any media now known or later developed, for any purpose related to operating the Site.
By submitting User Content, you represent and warrant that:
- The content reflects your own genuine, factual experience and is your original work;
- You have all rights necessary to grant the licence above and to publish the content (no non-disclosure agreement, employer confidentiality, or other restriction prevents you);
- The content does not contain false, misleading, defamatory, harassing, threatening, obscene, hateful, discriminatory, or otherwise unlawful material;
- The content does not infringe any third-party copyright, trademark, trade secret, privacy, publicity, or other right;
- You have not been paid or otherwise incentivised by any broker, competitor, or other party to submit the content.
We may, at our sole discretion and without notice, decline to publish, edit for length or clarity, anonymise, or remove any User Content. We are not obligated to monitor User Content but reserve the right to do so.
12. Intellectual property
The Site, including its design, layout, text, graphics, code, compilation, rankings, scoring algorithms, and other materials (excluding User Content and third-party trademarks), is protected by copyright, trademark, and other intellectual property laws. All rights are reserved. You may not copy, reproduce, distribute, transmit, modify, create derivative works of, publicly display, publicly perform, or otherwise use any part of the Site except as expressly permitted by these Terms or with our prior written consent.
The name "Forex Broker Checker", the Site's logo, and all related marks are trademarks of the Site's operator. Broker names, logos, and other identifying marks displayed on the Site (such as IG, eToro, Saxo Bank, Pepperstone, CMC Markets, and others) are the property of their respective owners. Their use on the Site is editorial — for the purpose of identification, comparison, and consumer research — and does not imply endorsement of, affiliation with, sponsorship by, or partnership with any of those owners. Such use falls within the doctrine of nominative fair use under applicable trademark law.
13. Watchlist and negative information — defamation defence
The Site publishes a watchlist of brokers that have been the subject of formal warnings, enforcement actions, or other adverse public action by recognised financial regulators, courts, or consumer-protection authorities. Watchlist entries:
- Reflect publicly available information at the date of publication, accurately reproduced or summarised in good faith;
- Cite or link to the originating regulator warning, court decision, or other primary public source where one exists;
- Are intended as consumer information of public interest, in the manner of legitimate journalism;
- Constitute fair comment / honest opinion on matters of public concern within the meaning of applicable defamation law;
- Are subject to a right of reply (see below).
Right of reply. Any broker listed on the watchlist, or any party acting on its behalf, may submit a formal request for correction, clarification, or removal by contacting the Site (see Contact). We will review any such request in good faith, consider any evidence provided, and where appropriate update, annotate, or remove the listing within a reasonable time. We will not, however, remove accurate references to public regulator warnings or court findings.
14. Third-party links and content
The Site contains links and references to broker websites and other third-party resources, and may embed third-party content (such as TradingView widgets, YouTube videos, or live market data). We do not control and are not responsible for the content, terms, privacy practices, business practices, products, services, or availability of any third-party site or service. Your interactions with any third party are solely between you and that third party. We strongly encourage you to read the terms and privacy policies of any third-party site before engaging with it or providing personal information.
15. Restricted jurisdictions and user responsibility
Some content on the Site (including links to specific brokers) may not be lawful in your jurisdiction. Many of the brokers featured may not be authorised to onboard clients from your country. You are solely responsible for ensuring that your use of the Site and any decision to open an account with any broker comply with all laws applicable to you, including financial-promotion rules, leverage caps, consumer-protection regimes, sanctions, and tax obligations. If accessing the Site or trading any product mentioned on the Site is unlawful in your jurisdiction, you must not use the Site or rely on its content.
16. Acceptable use
You agree not to:
- Use the Site in any way that violates any applicable law or regulation;
- Submit false, misleading, defamatory, or impersonating content;
- Reproduce, scrape, harvest, or systematically copy Site content without express written permission;
- Attempt to gain unauthorised access to the Site, its servers, or any data;
- Interfere with or disrupt the Site's operation;
- Use any automated means (including bots, crawlers, or scrapers) to access the Site beyond ordinary public crawling for indexing purposes;
- Use the Site to harass, threaten, or harm any person or entity.
17. Termination
We may, at our sole discretion and without notice, suspend or terminate your access to all or part of the Site at any time, for any reason or no reason, including suspected violation of these Terms. Termination does not affect any rights or obligations that accrued prior to termination, nor any provision that by its nature is intended to survive termination (including, without limitation, sections 8–10, 12, 18–23 and 26).
18. DMCA / copyright complaints
If you believe that any content on the Site infringes your copyright, you may submit a notice in writing to the Site (see Contact). Your notice must include: (a) your contact information; (b) identification of the copyrighted work allegedly infringed; (c) identification of the material on the Site claimed to infringe; (d) a statement that you have a good-faith belief that the use is not authorised; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the copyright owner; (f) your physical or electronic signature. We will review and respond to valid notices in accordance with the US Digital Millennium Copyright Act (DMCA) and equivalent laws of other jurisdictions, including by removing the allegedly infringing content.
19. Force majeure
We shall not be liable for any failure or delay in performance under these Terms caused by events outside our reasonable control, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, network or infrastructure failure, internet or telecommunications failure, denial-of-service attack, or any other condition that materially impairs our ability to deliver the Site.
20. Governing law and jurisdiction
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute relating to these Terms or the Site, save that we reserve the right to bring proceedings against you in any jurisdiction where you are domiciled or where you have caused harm to us.
21. Dispute resolution — informal negotiation first
Before initiating any legal proceeding against the Site, you agree to first attempt to resolve the dispute informally by contacting us in writing with a clear description of the dispute and the relief sought. We will attempt to resolve the dispute by good-faith negotiation within thirty (30) days of receipt of your notice. If the dispute cannot be resolved during this period, either party may proceed under the dispute resolution procedure below.
22. Class action waiver
To the maximum extent permitted by applicable law, you and Forex Broker Checker agree that any dispute will be resolved on an individual basis, and that neither party will bring or participate in any class, collective, representative, or consolidated action. The arbitrator (or court) shall not have the authority to consolidate claims of multiple parties or to preside over any form of class or representative proceeding.
23. Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
24. Entire agreement
These Terms, together with the Privacy Policy, Cookie Notice, and Methodology, constitute the entire agreement between you and Forex Broker Checker concerning your use of the Site and supersede any prior or contemporaneous communications, whether oral or written.
25. No waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged by us in writing.
26. Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may freely assign these Terms in whole or in part, including in connection with a merger, acquisition, reorganisation, or sale of assets.
27. Changes to these Terms
We may update these Terms at any time by posting a revised version on the Site. The "Last updated" date at the top of this page reflects the date of the most recent change. Material changes will be communicated by a notice on the Site for a reasonable period. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
28. Contact
For legal notices, takedown requests, correction requests, or other formal communication, please use the contact mechanism provided on the Site. We aim to respond to valid legal requests within thirty (30) days.
